1. Acceptance of Terms

Welcome to TokeHead (“Platform”), accessible at tokehead.com. TokeHead is owned and operated by Global Brand View LLC (“Company,” “we,” “us,” or “our”).

By accessing or using the Platform, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you must not use the Platform.

2. Eligibility

You must be at least eighteen (18) years old to use the Platform. By using the Platform, you represent and warrant that:

• You are at least 21 years of age
• You are legally permitted to use the Platform
• You will comply with all applicable laws and regulations

We reserve the right to verify age at any time.

3. Nature of the Platform

TokeHead is a user-generated content platform that may include:

• Short-form videos, live streams, and recorded content
• Cannabis-related discussions and media
• Social interaction features
• Optional restricted or mature-content sections (e.g., “TokeHead Blue”)

The Company does not create, control, or endorse user-generated content.

4. Cannabis & Legal Compliance

The Platform may contain cannabis-related content. You acknowledge and agree that:

• Cannabis laws vary by jurisdiction
• You are solely responsible for complying with all local, state, federal, and international laws applicable to your location and activities
• The Company does not facilitate, broker, or participate in the sale, purchase, or distribution of cannabis or controlled substances
• TokeHead is a licensed-business-friendly platform — only state-licensed and legally operating cannabis businesses may represent themselves as sellers, dispensaries, or commercial operators
• Unlicensed individuals may share personal cultivation as a hobby, personal use experiences, and educational content, but may not solicit sales, accept payment for cannabis, or represent themselves as a cannabis business of any kind
• Medically licensed patients may discuss their personal medical use and lawful personal cultivation where permitted by state law, but may not sell, barter, or transfer cannabis through or in connection with this Platform

The Platform is intended for informational, entertainment, community, and social purposes only. TokeHead expressly prohibits use of this Platform to facilitate any unlicensed commercial cannabis activity.

4a. Live Streaming & Commercial Activity Policy

Live streaming on TokeHead is subject to the following rules in addition to all other Terms:

• No unlicensed commercial solicitation. Streaming users may not use live broadcasts to offer cannabis for sale, accept orders, display pricing, or direct viewers to purchase cannabis from any unlicensed source.
• Hobby growers and personal use. Unlicensed individuals may stream personal cultivation for hobby or educational purposes. Displaying personal grows, sharing techniques, and discussing personal use is permitted. Any statement, offer, or implication of sale is strictly prohibited.
• Licensed businesses only for commercial activity. Only businesses holding a valid, current, government-issued cannabis license (retail, cultivation, distribution, manufacturing, or delivery) may use live streams to promote their business, products, or services. License verification may be required by TokeHead at any time.
• Medical patients. Individuals holding a valid medical cannabis card may discuss their lawful personal medical use and cultivation where permitted by state law. They may not sell, gift with expectation of compensation, barter, or transfer cannabis in connection with this Platform.
• No transaction facilitation. TokeHead does not facilitate cannabis transactions of any kind. Any attempt to use the Platform’s messaging, gifting, payment, or live stream features to arrange cannabis sales is a violation of these Terms and may violate federal and state law.
• Reporting. Users are encouraged to report suspected unlicensed commercial activity via the in-app report function or by emailing support@tokehead.com.

TokeHead is committed to operating a platform that only licensed, compliant cannabis businesses can use commercially. This policy protects our users, our platform, and the legal cannabis industry.

5. User Content & License

You retain ownership of content you submit. However, by submitting content, you grant the Company a worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable license to use, reproduce, distribute, display, modify, and perform such content in connection with the Platform.

You represent and warrant that you own or have all necessary rights to your content and that your content does not violate any laws or third-party rights. We may remove or restrict content at any time, for any reason.

6. Mature & Restricted Content Areas (“TokeHead Blue”)

Certain areas of the Platform may contain mature, suggestive, or provocative content intended for adult audiences. By accessing such areas, you acknowledge that you do so voluntarily, content may not be suitable for all audiences, and the Company makes no guarantees regarding content type or appropriateness.

The Company reserves the right to restrict access to such areas and enforce content standards at its sole discretion.

7. Prohibited Conduct

You agree not to:

• Violate any applicable laws or regulations
• Promote or facilitate illegal activity
• Upload infringing, harmful, or deceptive content
• Attempt to exploit, hack, or disrupt the Platform
• Engage in fraud, scams, or impersonation
• Solicit, advertise, or facilitate the sale or transfer of cannabis or cannabis products without holding a valid, current state-issued cannabis retail, distribution, or delivery license
• Represent yourself or your account as a licensed cannabis business, dispensary, delivery service, or brand without verified licensure
• Post pricing, menus, order links, payment requests, or any commercial solicitation related to cannabis without holding the appropriate license in your operating jurisdiction
• Use live streams, direct messages, posts, or any Platform feature to arrange unlicensed cannabis transactions of any kind

Violations of the above may result in immediate account termination, content removal, and referral to applicable regulatory or law enforcement agencies. We may suspend or terminate accounts at our sole discretion, with or without notice.

7a. Child Safety Standards

TokeHead has zero tolerance for child sexual abuse material (CSAM), the sexual exploitation of minors, or any conduct that endangers children. TokeHead is a 21+ adult cannabis community; users under 18 are prohibited. Suspected CSAM is removed immediately, accounts are permanently terminated, and reports are transmitted to the National Center for Missing & Exploited Children (NCMEC) CyberTipline as required by 18 U.S.C. § 2258A. To report child safety concerns, use the in-app Report control on any post, profile, message, or stream, or email safety@tokehead.com. Full policy: Child Safety Standards.

8. Payments, Credits & Digital Features

The Platform may include paid features, digital credits, or virtual items. You acknowledge and agree that:

• Such items do not constitute real currency or property unless explicitly stated
• All purchases are final and non-refundable, except where required by law
• The Company may modify, suspend, or discontinue such features at any time
• Chargebacks or payment disputes may result in account suspension or termination

Payments may be processed through third-party providers such as Stripe.

9. Digital Currency (“Sparks”)

The Service includes virtual currency called “Sparks.” You acknowledge that:

• Sparks are not money and have no intrinsic value
• Sparks do not constitute property, currency, or stored value
• Sparks are a revocable license granted by the Company
• The Company retains absolute discretion to modify, devalue, or eliminate Sparks
• Sparks may be confiscated in cases of violation of these Terms

All Sparks purchases are final and non-refundable unless required by law.

10. Creator Monetization

Users who monetize content (“Creators”) acknowledge they are independent contractors, not employees, and that no wages, benefits, or employment rights are provided. The Company does not guarantee earnings, exposure, or success. Creators are solely responsible for taxes, legal compliance, and financial reporting related to any income earned through the Platform.

11. TokeHead Creator Program

TokeHead Creator is an optional $9.99/month subscription. Pricing may change with advance notice; any change will be communicated before it takes effect and will not apply to a billing period already paid. TokeHead Creator status is tied to an active subscription and ends when the subscription is cancelled.

12. AI Systems & Automation

The Service may utilize artificial intelligence and automated systems. Outputs may be inaccurate, misleading, or offensive. Moderation may be performed automatically and decisions may occur without human review. The Company disclaims all liability related to AI-generated content, moderation decisions, and algorithmic outcomes.

13. No Medical, Legal, or Professional Advice

Content on this site is provided for general information and entertainment purposes only. It is not medical advice, and it is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Always consult a physician or other qualified healthcare provider before consuming cannabis in any of its forms — including flower, edibles, concentrates, vaporized products, tinctures, topicals, and CBD or hemp-derived products. This is especially important if you:

• take prescription medication — cannabis and CBD can interact with other drugs, including blood thinners such as warfarin, and can alter how your body processes them;
• have a heart, liver, respiratory, or psychiatric condition;
• are pregnant, planning to become pregnant, or breastfeeding;
• are under the care of a physician for any ongoing condition.

Never stop, reduce, or change a prescribed medication based on anything you read here. Never delay seeking professional medical care because of content on this Platform. If you are experiencing a medical emergency, contact your local emergency services.

Our research articles summarize published, peer-reviewed studies and link to their original sources. Those summaries are journalism, not clinical guidance, and they are not a substitute for a conversation with your own clinician. Individual responses to cannabis vary widely with dose, product, method of consumption, tolerance, and personal health history. Statements about cannabis or CBD on this Platform have not been evaluated by the U.S. Food and Drug Administration.

You agree not to rely on Platform content for medical advice, legal advice, or financial decisions. The Company disclaims all liability arising from reliance on such content.

14. Intellectual Property & Copyright (DMCA)

We respect intellectual property rights and comply with the Digital Millennium Copyright Act. We may remove allegedly infringing content and terminate repeat infringers. Users must submit valid takedown notices via our DMCA Takedown Form or email support@tokehead.com.

15. Account Security

You are responsible for maintaining the confidentiality of your account credentials and all activities conducted under your account. The Company is not liable for unauthorized access or losses resulting from compromised accounts.

16. Service Availability & Modifications

We may, at any time, modify or discontinue features, change pricing or functionality, or restrict or terminate access, without liability.

17. Beta Features & Experimental Systems

The Service may include experimental features and beta functionality. These features may be unstable, modified, or removed at any time. The Company is not liable for any resulting losses or data issues.

18. Inactive Accounts

We may suspend or terminate inactive accounts and forfeit unused Sparks or balances after extended inactivity in accordance with applicable law.

19. Limitation of Liability

To the maximum extent permitted by law, the Platform is provided “AS IS” and “AS AVAILABLE.” The Company shall not be liable for indirect, incidental, or consequential damages; loss of profits, data, or goodwill; user-generated content; or third-party actions. Total liability shall not exceed the amount paid by you in the preceding 12 months.

20. Indemnification

You agree to indemnify and hold harmless the Company from any claims arising out of your use of the Platform, your content, or your violations of these Terms.

21. Arbitration & Class Action Waiver

All disputes shall be resolved through binding arbitration in the State of Nevada. You waive the right to a jury trial and the right to participate in class actions.

22. International Use

You are responsible for compliance with laws in your jurisdiction. We may restrict access to the Platform in certain regions.

23. Force Majeure

We are not liable for failure or delay caused by events beyond our control, including system failures, cyberattacks, or infrastructure outages.

24. Termination

We may suspend or terminate your account at our sole discretion, with or without notice, for any reason including violation of these Terms.

25. Governing Law

These Terms are governed by the laws of the State of Nevada.

We are not responsible for the privacy practices of third-party services integrated with the platform.

10. Updates

We may update this Privacy Policy at any time. Continued use of the Service constitutes acceptance of the updated policy.
